If changes or modifications are desired to the approved design the Building Division must approve the modifications prior to alteration. Your design professional will need to submit revised plans to the Building Division for approval.

Unlicensed Persons* are limited to the design of: • Single-family dwellings of wood frame construction not more than two stories and/or including basement in height. • Multiple dwellings containing no more than four dwelling units of wood frame construction not more than two stories and basement in height. Not more than four dwelling units per lot. • Garages or other structures appurtenant to dwellings, of wood frame construction not more than two stories and basement in height. • Agricultural and ranch buildings of wood frame construction.* • Nonstructural store fronts, interior alterations or additions, fixtures, cabinetwork, furniture, or other appliances or equipment including nonstructural work necessary to provide for their installation. • Nonstructural alterations or additions to any building necessary to or attendant upon the installation of such storefronts, interior alterations or additions, fixtures, cabinetwork, furniture, appliances, or equipment. • May not design any component that affects the safety of any building or its occupants, including but not limited to structural or seismic components. * Unless the building official having jurisdiction deems that an undue risk to the public health, safety or welfare is involved Structural Engineers * have no Limitations; may design any building of any type. In California, anyone who contracts to perform work that is valued at $500 or more for materials and labor must hold a current, valid license from the Contractors State License Board in the specialty for which he or she is contracting.

In the Town of Los Gatos single family homes are allowed to run the condensate drain to a landscape area. The landscape area should be larger than six square feet. If in a hillside area, a minimum 12"diameter x 12" depth dry well is required.

If you are removing stucco or siding to do the replacement, or if the structure is considered historic you need a permit. Wood fences 6 feet or less in height do not require a building permit. A property line wall constructed of concrete masonry units (CMU), precast panels or stucco covered would require a permit. See Town of Los Gatos Code section 29.10.020.

In residential zones, fences, hedges and walls not over six feet are allowed on or within all property lines, except that no owner or occupant of a corner lot or premises in the Town shall erect or maintain upon such lot or premises any fence, hedge or wall higher than three above the curb in a traffic view area unless a permit is secured from the Town Engineer. A traffic view area is the area which is within fifteen feet of a public street and within two hundred feet of the right of way line of an intersection. Please refer to Section 29.40.030 of the Town Code for additional information.

A one story detached accessory structure to be used for a tool or storage shed, playhouse or similar use with a floor area of 120 square feet or less and a maximum height of 15 feet does not required a building permit. Please contact the Planning Division for zoning regulations. Electrical or plumbing work within detached accessory structures will require permits.

ARC fault protection is required for all 15 and 20 amp receptacles in all sleeping rooms for new construction. If an entirely new bedroom is added to existing home, ARC fault protected will be required. Expansion of an existing bedroom would not require ARC fault protection.

Yes, typically you can use a #4 bare copper wire to jump from water line to gas at the water heater.
|
|
|
Damage and inconvenience due to a sewage backup can be prevented or significantly reduced with the installation of a backwater valve. If a structure has a plumbing fixture below the public sewer system, a backwater valve can help stop sewage from backing into your business or home when the public system has a blockage. A properly installed backwater valve works on a one-way system; sewage can flow out, but not back in, therefore preventing damage to your property. Not all homes or commercial buildings need a backflow valve. New structures, new installation or alterations of plumbing fixtures require the installation of a backwater valve if the lowest finished floor elevation is less than one foot above the uphill manhole cover of the public sewer system. Existing homes or commercial buildings located in older parts of Los Gatos may have been constructed or had plumbing repairs completed before the requirement of a backwater valve and may need backflow protection. Los Gatos Town Code section 22.20.055(b) provides the Town of Los Gatos is not liable for damage resulting from sewer overflow where the property owner or other person has failed to install and maintain a backflow valve. The Town suggests that while you are working on your plumbing system you have your plumber or West Valley Sanitation District investigate your property to see if a backwater valve is necessary to protect your property. Although the cost can vary, the one-time cost may save your personal property and help eliminate potential unnecessary hardships.

Garage Sale participants are asked to hold their garage sales from 9:00 am to 3:00 pm on Saturday May 17, 2008. If you are a buyer, we recommend going out before 12 noon, we anticipate lots of shoppers out that day.

Encroachment Permits are required from property owners and utility companies for any work conducted in the public right-of-way. The public right-of-way mainly includes streets and sidewalks; just think of it as any public area that is adjacent to your home. For any improvements or any situation where you or your contractor plans to encroach upon the public right-of-way, (such as concrete work, brick work, landscaping, and including storing or placing anything in the street/sidewalk/public area during construction), an encroachment permit is required in advance. Encroachment Permits are obtained from the Town's Engineering Department. Town Engineers will review your improvement plans and determine the fee and assist you in obtaining the necessary paperwork to approve your project. For instance, if the work in the public right-of-way is non-standard (such as colored or stamped concrete) a signed Indemnity Agreement is required from the property owner. Also, each homeowner needs to have proof of Liability Insurance in the amount of $300,000 while encroaching upon the public way. Yes. The Los Gatos/Monte Sereno Police Department has launched an innovative outreach program to welcome new residents. Launched in May 2008, uniformed police volunteers from the Volunteers in Policing Program personally welcome new residents. Residents receive packets of useful community information, including letters from the Town Manager and Chief of Police, an overview of Town services, emergency preparedness and home safety information and gift certificates from local businesses. Children receive Town pins, stickers, and police badges. The Town of Los Gatos and Police Department are offering this new service to further its goal of "knowing everyone in the community," a worthwhile endeavor which has already demonstrated its value to the community. There are six public lots that are without time limits and are within one or two blocks of the downtown area:
- South Side Lot located at S. Santa Cruz Ave. just south of the Post Office accross from the Toll House Hotel.
- Park Ave. Lot located on Park Ave. at W. Main St.
- Underground parking in Lot #4 on Railroad Way between Elm and Gray's.
- Miles Avenue - Lot at the bottom of the hill.
- Montebello Lot on Montebello next to the Post Office.
- North Side Lot located on the north side of Highway 9 between University and N. Santa Cruz.

Vehicles may be parked on the street overnight in residential zones with certain restrictions such as parking for purpose of display, repair, storage, etc. Vehicles parking with in the residential zoned area must have a current parking permit on the vehicle. Overnight parking in downtown lots is prohibited where posted.

You will be required to fill out a "Parking Appeal Investigation" form, stating your reason(s) for believing the citation was issued in error or why you are not responsible for the alleged violation. You will be notified of the decision by mail, usually within 30 calendar days.

Yes! If your Administrative Investigation is denied you may appeal. You have 21 days from the date the denial notification was mailed to file a written request with an explanation for this review. No official form is provided for this request. Mail your appeal with the full amount of the ticket to Town of Los Gatos, PO Box 973, Los Gatos, CA 95031 or deliver in person to 110 East Main Street, Los Gatos. The full amount of the citation will be refunded if your citation is dismissed, the amount is forfeited if the citation is deemed valid. If your appeal to the Town is denied, an appeal may be filed in the Santa Clara County Civil Court within 21 days from date of denial. This court will review the factual aspects of the case, the administrative process, and the decision of the Hearing Examiner. The decision of the Civil Court may be communicated in person or by mail.

Yes! They may be acquired at the Los Gatos Clerk Department, Monday through Friday, between the hours of 8:00 am - 5:00 pm. There is a per vehicle fee of $26.00 for one day and $5.00 for each additional day.

The curb coloring indicates a restiction on parking:
- RED curb means no parking at any time.
- YELLOW curb indicates a commercial loading zone and is restricted to the offloading of commercial freight with a time restriction of 30 minutes.
- GREEN curb is time limited - there will be a sign posted indicating the duration, usually 30 minutes.
- WHITE curb indicates a passenger loading zone and is for dropping off and/or picking up passengers only. There is a 10 minute allowance for this purpose.
- BLUE curbs will be accompanied by the blue and white disabled person sign. These parking stalls are restricted 24 hours a day, 7 days a week and are for the use of disabled persons with the properly displayed permits ONLY.

In most cases, yes, however some restrictions are controlled by a sign only. For example, the curb may not be painted green but if there is a sign posted that limits parking to 30 minutes - the 30 limits limitation will be enforced. Another example would be at a fire hydrant that does not have an accompanying red curb. It is still a violation to park within 15 feet of a fire hydrant.

The Town has returned some previously restricted parking to regularly available parking by painting over the previously colored curb with gray paint.

Yes, but only for FIRE LANE and HANDICAPPED STALL enforcement. One is mandated by the fire marshall and the other by the Town. Both are conditions of the property owners use permit.

Call the Abandoned Vehicle Hotline (408) 399-5716, 24 hours a day, 7 days a week or complete the Abandoned Vehicle Complaint Form (pdf) and fax it to (408) 354-0578. Have available a description of the vehicle, location, license number and how long it has been there. An officer will respond as soon as available. Please note that vehicles parked on private property are not the responsibilty of the Police Department. Only vehicles parked on Town owned streets, alleys, and off street parking facilities are responded to. You may call the Los Gatos-Monte Sereno Police Department 24hrs a day, at 354-8600 (the non-emergency number). Please provide the police dispatcher with the license plate number of your vehicle, and the location from which you think it may have been towed. The dispatcher will check the status of your vehicle, and advise you if it was towed, and whether it was “stored,” or “impounded." If your vehicle was “impounded,” this means that the police department has placed a hold on the vehicle, and it may not yet be available for release. The most common reason for a vehicle impound is that it was driven by a suspended or unlicensed driver. If this is the case, the vehicle will be held for a period of 30 days, and you must wait for this time to elapse before requesting a release. After the 30 day period has passed, the registered owner may come to the police department to obtain a release. A fee of $150.00 will be charged for release of stored or impounded vehicle, and the registered owner will be required to show a valid driver’s license. Should the registered owner not have a valid license, a valid picture I.D., and the presence of a licensed driver, will be needed. Note, you may also be charged by the towing company for towing and storage before they will release the vehicle. If your vehicle was “stored”, it is available for immediate release. The procedure for this release is the same as for an impounded vehicle, but without the waiting period.
